Parking Passes & Season Tickets

1. Definitions
In these terms:
- "We", "Us", "Our" refers to The Kyle Rise Ltd, trading as Kyle Rise Car Park.
- "Pass" refers to any weekly pass, monthly pass, residents pass or season ticket purchased through this portal.
- "Pass Holder" refers to the individual or vehicle registered to a pass.
- "Car Park" refers to Kyle Rise Car Park, Carrick Street, Ayr, KA7 1RZ.
2. Pass Terms
2.1 Weekly Passes
Weekly passes entitle the registered vehicle to park on the specified number of days per week (3, 5, or 7 days) for one week from the date of purchase. Weekly passes are valid from the date of purchase and expire at midnight 7 days later.
2.2 Monthly Passes
Monthly passes entitle the registered vehicle to park for the specified number of days within a calendar month, or unlimited days for the Calendar Month option. Monthly passes are valid from the date of purchase and expire at midnight on the last day of the calendar month.
2.3 Residents Passes
Residents passes provide unlimited 24/7 parking access for one calendar month from the date of purchase. Residents passes are available only to those who reside in the immediate vicinity of Kyle Rise Car Park.
2.4 General Pass Conditions
- Passes are valid for one vehicle only, as identified by the registration number provided at purchase.
- Passes are non-transferable and may not be shared, resold, or assigned to another person or vehicle.
- The vehicle registration must be entered accurately. We are not responsible for enforcement action taken due to incorrectly entered registrations.
- A pass does not guarantee the availability of a parking space. The car park operates on a first-come, first-served basis.
- Pass holders must comply with all signage, speed limits, and directions within the car park at all times.
- Vehicles must be parked wholly within a marked bay.
- The car park speed limit is 5 mph.
3. ANPR & Enforcement
Kyle Rise Car Park uses Automatic Number Plate Recognition (ANPR) technology to monitor vehicle entry and exit. Pass holders are identified by their registered vehicle number plate — there is no physical permit to display.
Important: If you change your vehicle, you must purchase a new pass with the correct registration number. Your old pass cannot be transferred to a new vehicle.
4. Refund Policy
4.1 Cooling-Off Period
You may request a full refund within 14 days of purchase, provided the pass has not been used (i.e. the registered vehicle has not entered the car park during the pass period). To request a refund, contact us on 0345 548 1716 or email info@kylerise.info.
4.2 Used Passes
Once a pass has been used (the registered vehicle has entered the car park), no refund will be issued. Partial refunds are not available for unused days within a pass period.
4.3 Cancelled Passes
If your pass is cancelled due to a breach of these terms (see Section 5), no refund will be issued.
4.4 Processing
Approved refunds will be returned to the original payment method within 5–10 business days.
5. Cancellation & Revocation
⚠️ We reserve the right to cancel any pass immediately and without refund if the pass holder engages in any of the following:
5.1 Antisocial Behaviour
- Aggressive, threatening, or abusive behaviour towards staff, other users, or members of the public
- Excessive noise, including loud music from vehicles, particularly between 22:00 and 07:00
- Loitering, congregating in groups in a manner that causes intimidation or obstruction
- Reckless or dangerous driving, including speeding, drifting, or racing within the car park
- Consumption of alcohol or illegal substances on the premises
- Any criminal activity
5.2 Littering & Property Damage
- Dropping, leaving, or dumping litter, rubbish, or waste anywhere within the car park
- Fly-tipping or disposing of household or commercial waste
- Damage to car park infrastructure, signage, barriers, lighting, CCTV cameras, or payment equipment
- Graffiti or vandalism of any kind
- Spillage of oil, fuel, or other substances without reporting to management
5.3 Misuse of Passes
- Sharing, lending, or selling a pass to another person
- Using a pass with a vehicle other than the one registered
- Attempting to circumvent ANPR, barriers, or payment systems
- Providing false information during purchase
5.4 Enforcement Process
Where a breach is identified:
- First offence: A written warning may be issued (at our discretion).
- Serious or repeated offence: The pass will be cancelled immediately with no refund.
- Criminal matters: Will be reported to Police Scotland. CCTV evidence will be provided.
The car park is monitored by 24/7 CCTV and subject to regular patrols by both our management team and Police Scotland.
6. Liability
- Vehicles are parked at the owner's risk. We accept no liability for loss of or damage to vehicles, their contents, or personal property.
- We are not liable for any consequential loss arising from the car park being full, closed, or access being restricted.
- We accept no liability for damage caused by other car park users or third parties.
7. Data & Privacy
We collect and process personal data (name, vehicle registration, address for residents) for the purposes of administering parking passes and enforcing car park terms. ANPR data is processed for legitimate business purposes. Data is retained in accordance with our privacy policy and applicable data protection legislation.
8. Changes to Terms
We reserve the right to amend these terms at any time. The latest version will always be available on this page. Continued use of a pass after changes are published constitutes acceptance of the updated terms.
